Five Reasons To Take The Precautionary Approach To Deep Sea
Di: Amelia
Impacts of Deep Seabed Mining The marine environment is complex, and a number of components need to be measured and understood before any assessment of possible impact of deep-sea marine mining is made. A comprehensive understanding of the dynamic regime of any site is required. Impacts based on physical oceanography, geology,
Prevention Principle and the Precautionary Principle
Precautionary Approach in A deep sea mining context I am one of the many products of the capacity-building initiative of the EU-SPC DSM Project’s Legal internship program. I was given the opportunity to work with the DSM project in Suva, last year as a legal intern. The precautionary approach is not expressly provided for in the United Nations Convention on the Law of the Sea 1982 (UNCLOS).2 However, it is found in the head of the International Seabed Authority’s (ISA) Exploration Regulations3 and Draft Exploitation Regulations,4 and discussed in the Seabed Advisory Opinion.5 This chapter reviews the ISA’s Over the past half-century, ocean scientists have begun to describe the least-known places on Earth: the deep realms of the international seabed. Aided by new technologies, the pace of the seabed inventory has accelerated in recent years.

Observers highlighted, among other things, the need to: rigorously apply the precautionary principle; incorporate multiple knowledge systems; take into account that restoration and offsetting are not realistic options for the deep-sea; and ensure public involvement and meaningful stakeholder engagement. This article also explores the essential requirements of taking precautionary approaches for governing commercial deep seabed mining. Environmental groups: Greenpeace and the Deep Sea Conservation Coalition are at the forefront of opposing deep-sea mining. They advocate for a precautionary approach, emphasizing the need for more

Higher level of environmental protection through precautionary decision-making in the case of risk Within continental shelf areas, additional resources include phosphorites, ironsands and diamonds. No commercial deep seabed mining has yet taken place, but Nautilus Minerals and Diamond Fields International have obtained permits to extract minerals in the Bismarck Sea and Red Sea, respectively.
The ISA has issued 31 exploration contracts, and while exploratory small-scale mining has taken place to test equipment, commercial mining of the deep sea bed has not yet started.
That means deep-sea mining could start even with the absence of a mining code. This would launch a new extractive industry mining by complying for metals at depths reaching 4-5 kilometers, with the primary immediate interest being around polymetallic nodules in

The International Seabed Authority (ISA), established under the United Nations Convention on the Law of the Sea, is responsible for the governance of deep-sea mining in areas of the ocean beyond national jurisdiction (DSM), including the adoption of rules, regulations and procedures (RRPs) relating to DSM. The precautionary principle has come to the fore in risk discourse. It calls for early measures to avoid and mitigate environmental damage and health hazards in the face of uncertainty. This paper reviews the history of and current research on the principle and The Pacific Possible: Precautionary Management of Deep Sea Mining Potential in Pacific Island Countries is a stocktaking exercise, highlighting the knowns and unknowns of this growing industry.
Contemporary environmental law is based on foundations externalized by legal principles. The growing importance of the precautionary principle raises the question of its position among other principles of EU environmental law and, in particular, its relationship with Rules for the emerging deep-sea mining sector should take a „precautionary approach“ that protects the environment, the head of the body drafting regulations for the practice told AFP Friday. Rules for the emerging deep-sea mining sector should take a „precautionary approach“ that protects the environment, the head of the body drafting regulations for the practice told AFP Friday. At stake is a potential new frontier for developing mineral resources like nickel, cobalt and copper that are crucial for renewable energy technology.
OceanCare remains extremely concerned about the irreversible damage that can be caused by deep-sea mining, particularly through underwater noise pollution. To date, 27 States have joined actors from science, business, finance, and civil society in calling for a moratorium, precautionary pause, or a ban on deep-sea mining. All management measures taken by States or RFMO/As should be in compliance with other international instruments for the management of deep-sea fisheries, and be based on the precautionary approach and the ecosystem approach to fisheries.

The European Union itself has also been a strong advocate of a precautionary pause on deep-sea mining. In February of 2024, the European Parliament voted in favour of a resolution reaffirming its support for a moratorium and calling on the European Union Commission and Member States to apply a precautionary approach. Current regulations governing deep-sea mining are not enough to protect the ocean.
Pacific Blue Line collective, made up of women, youth, faith-based, and environmental organisations, is demanding „for an outright ban on deep sea mining“ as Pacific leaders meet in Fiji. These principles with regard to mineral resource regulation in the icy and fragile Antarctic frontier operationalize the precautionary approach and can generate valuable lessons for regulating the future deep-sea mining industry to protect the remote, dark and similarly fragile deep ocean frontier. This precautionary policy approach can be considered an alternative intellectual framework — or mindset — for legitimizing more ambitious financial policy interventions in the present to better deal with these long-term risks. Two qualifications should be noted.
It would also align with the Vemööre Declaration adopted at the High‐level Segment of the 10th Pacific Islands Nature Conservation and Protected Areas Conference in 2020, which calls for: “Entrenching a precautionary approach to any proposed deep‐sea and seabed mining activities. A sizable number out of the 169 member states of the ISA have spoken out in favour of a precautionary pause or moratorium on deep-sea mining.
Deep-sea mining (DSM) may become a significant stressor on the marine environment. The DSM industry should demonstrate transparently its commitment to preventing serious harm to the environment by complying with legal requirements, using environmental good practice, and minimizing environmental impacts. Here existing environmental management What does it mean? Introducing the precautionary approach, Principle 15 of the 1992 Rio Declaration states that “where there are threats of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation”. Precaution involves the systematic application of risk assessment, Understanding and Applying the Precautionary Principle to Deep Sea Minerals Mining in the Pacific Islands Region: A Socio-cultural and Legal Approach Summary What is the Precautionary Principle? The principle provides guidance on a process for avoiding serious or irreversible harm under conditions of uncertainty. Precautionary measures are triggered when, for a given action,
Both terms align with the precautionary principle (or approach), which is widely accepted in international law, and required by the ISA Mining Code. 43 The precautionary the 10th approach requires that where there are risks of environmental harm, early measures need to be taken to protect the marine environment, even if scientific

The precautionary approach is a key tool to address the environmental protection challenges posed by deep seabed mining, both at a regulatory and at a management level.
This article examines the legal basis and potential pathways for a precautionary pause or moratorium for deep seabed mining of the international seabed “Area”, should members of the International Seabed Authority choose to do so, and discusses possible unintended policy implications that could arise therefrom.
